Acceptance of Terms

By visiting or otherwise using any service operated by trysmart Store, you confirm that you accept and will comply with these Terms of Service together with every applicable federal, state, and local statute and regulation. Should you disagree with any portion of these terms, you may not access or use any trysmart Store offering. Anyone who uses the service on behalf of a company or other organization affirms that they hold the authority to commit that entity to these terms.

Use of the Website

You agree to access trysmart Store's services solely for lawful, personal, and non-commercial purposes unless trysmart Store has granted you written authorization to do otherwise. You must not:

• Submit fraudulent, excessive, or malicious orders, including orders placed without any intention of receiving the goods
• Resell trysmart Store products for commercial profit without our explicit written consent

Product Information and Pricing

trysmart Store works diligently to keep product descriptions, prices, specifications, and availability details accurate and current. Should an error arise in product information, pricing, or availability, we retain the right to rectify that error and to cancel any order placed on the basis of the incorrect information at no cost to you. For goods that naturally vary (such as handmade items or products made from natural materials), minor differences in dimensions, weight, or appearance from the listed specifications may occur. Product details and warnings are furnished for reference only; trysmart Store cannot warrant that products are free from cross-contamination during processing or packaging. Product availability may differ by delivery zone, pickup location, and chosen time slot.

Orders and Payment

Every order depends on product availability and acceptance by trysmart Store. We retain the right to decline or cancel any order at our sole discretion, including orders that appear fraudulent, breach these terms, or cannot be fulfilled because of stock shortages. Full payment must be received before an order is dispatched or collected, unless we have agreed otherwise in writing. Minimum order values and delivery fees may apply depending on your chosen delivery zone and time slot. For age-restricted products (including alcohol, tobacco, and vaping products where legally permitted), you must meet the legal age to purchase such items in your jurisdiction, and valid government-issued ID will be required at delivery or pickup. Should an item in your order be out of stock, we will inform you before dispatch and may propose a suitable substitute, or refund the unavailable item, unless you have opted out of substitutions at checkout.

Intellectual Property

All content on trysmart Store's platforms — including text, images, logos, software, private label product packaging, and the "trysmart Store" name and branding — is the exclusive property of trysmart Store and is safeguarded by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any trysmart Store content without our explicit written consent. User-generated content (including product reviews, photos, and comments) submitted to our platforms may be used by trysmart Store for marketing, promotional, or operational purposes, in accordance with our Privacy Policy.

User Responsibilities

You are responsible for keeping your account credentials confidential and for all activities conducted under your account. You must alert trysmart Store immediately to any unauthorized use of your account or any other security breach. You are likewise responsible for supplying accurate, current contact, delivery, and payment information when placing orders, and for ensuring that any special instructions, eligibility requirements, or product-specific conditions you submit are truthful and complete. Limitation of Liability

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of trysmart Store's services shall first be submitted to trysmart Store's customer support team for informal resolution. If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration administered by a recognized arbitration provider in New York, NY, in accordance with the provider's commercial arbitration rules. The award of the arbitrator shall be final and binding on the parties, and may be entered in any court of competent jurisdiction.

Changes to These Terms

trysmart Store reserves the right to update, modify, or replace any part of these Terms at any time at our sole discretion. If we make material changes to these Terms, we will provide at least 30 days' advance notice via email to the address associated with your account, or via a prominent notice on our website. Your continued use of our services after the effective date of any revised Terms constitutes acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using trysmart Store's services prior to the effective date of the changes.
